Terms and Conditions- Article 3

3.1 The Lessee agrees to return the vehicle to the pick-up point within the period specified in this Agreement.

3.2 The Lessee agrees to return the vehicle earlier than the agreed deadline upon the Lessor’s request.

3.3 The Lessee commits to returning the vehicle in good condition and without damage, along with all documentation, keys, tires, tools, mandatory, standard, and additional equipment, and with a full tank as received.

3.4 Monetary obligations under this Agreement, if not paid in advance or as a deposit, must be settled promptly by the Lessee, either upon returning the vehicle or within 7 days of the payment request being made or the invoice being issued.

3.5 The Lessee commits to securing the vehicle when not in operation, holding onto the keys and documentation, and activating any additional safety features present on the vehicle.

3.6 The vehicle should not be used for engaging in criminal activities, customs violations, foreign exchange violations, or other illegal actions. It should not be leased to third parties, used for transporting goods, cargo, or passengers for payment, towing other vehicles or trailers, racing, driver training, or carrying materials that could damage or soil the vehicle (such as animals, highly flammable substances, excessively dirty items, or items with a strong odor). Additionally, the vehicle should not be operated under the influence of alcohol, drugs, or any other intoxicating substances. Should the Lessee violate these terms, they are obligated to promptly compensate the Lessor for any resulting damages.

3.7 The Lessee agrees not to cross the state border with the leased vehicle without obtaining a green card from the Lessor beforehand. If the Lessee crosses the state border without obtaining a green card in advance, they must accept full financial liability towards the Lessor and the relevant authorities of the country where they are located with the leased vehicle for the offense committed.

3.8 The Lessee agrees not to modify any components, assemblies, gadgets, or equipment, or alter the external appearance of the vehicle without the Lessor’s written approval. The Lessee must reimburse the Lessor for any altered or missing parts at their market value by the vehicle’s return date.

Terms and Conditions – Article 4

4.1 The Lessee commits to timely requesting an extension of the lease term and any other lease modifications from the Lessor.

4.2 If the Lessee surpasses the agreed-upon deadline for returning the vehicle without the Lessor’s consent, the Lessor reserves the right to deem the vehicle stolen and report it to the authorities. Consequently, the Lessee is liable for any ensuing damages.

4.3 If the deadline for returning the vehicle is exceeded, the Lessee remains obligated to all responsibilities and conditions outlined in this Agreement.

4.4 The Lessor retains the authority to oversee any vehicle at all times. In the event of a breach of any terms of this Agreement by the Lessee, the Lessor is entitled to seize the vehicle.

4.5 The Lessor retains the unconditional right to terminate the Vehicle Rental Agreement at any time and place before its expiration, without any obligation to compensate the Lessee.

Terms and Conditions – Article 5

5.1 The Lessee ensures and commits to: taking possession of the leased vehicle and using it in compliance with the Road Traffic Safety Act and other applicable regulations; ceasing driving promptly if the vehicle’s odometer malfunctions and notifying the Lessor immediately; using the vehicle solely for personal requirements; and allowing only the Lessee or an additional driver specified in the Contract to operate the vehicle.

5.2 The Lessor bears no responsibility for any damages to individuals or items being transported in the vehicle. The Lessee must return the vehicle promptly and to the designated location as per the Agreement. Should there be a requirement to prolong the lease duration, a new contract will be executed once the Lessee fulfills all duties from the prior Agreement.

Terms and Conditions- Article 6

6.1 This Agreement is prepared in 3 identical copies, with one copy given to the Lessee and the others retained by the Lessor. By signing the initial page of this Agreement, the Lessee acknowledges and agrees to all its terms. Any modifications to this Agreement must be documented in writing, as oral agreements hold no validity. Should a dispute arise, the parties involved will seek an amicable resolution outside of court; otherwise, they will defer to the jurisdiction of the First Basic Court in Belgrade. The Law on Obligations of the Republic of Serbia will govern matters not addressed in this contract.

Guidelines for the Lessee’s Response in the Event of a Traffic Accident

Police records are required for all insurance types. Failure to provide the police report and the completed “European Traffic Accident Report” by the vehicle’s Lessee will result in the Lessee being held liable for the full amount of damage and/or theft, irrespective of the insurance coverage. The police report and the “European Traffic Accident Report” must be completed even if the Lessee was not present during the vehicle damage incident (e.g., damage caused by an unidentified individual in a parking lot).

In the event of a traffic accident, damage, or theft of the rented vehicle, the Lessee must promptly inform both the police and the Lessor of the incident and comply with their directives. The Lessee must also possess a valid driving license for the vehicle category rented and have a green card if driving the vehicle internationally. In such instances, the insurance coverage is rendered void, and the Lessee is accountable for the entire cost of the damage or theft.
